By providing your phone number and checking the consent boxes on our web forms, you agree to receive SMS text messages from Shift Containers regarding your quote, dispatch updates, and occasional marketing offers. Message frequency varies. Message and data rates may apply.

Opting Out: You may opt out of receiving SMS text messages at any time by replying STOP to any message you receive from us. For assistance, reply HELP. Mobile carriers are not liable for delayed or undelivered messages.

TERMS OF SERVICE AND CONDITIONS

By using the Shift Containers website and submitting a quote request, you agree to be bound by the following Terms and Conditions.

1. Company Role and Subcontractor Disclosure

Shift Containers operates strictly as a lead generation, marketing, and dispatch facilitation network. We are not a licensed motor carrier, freight forwarder, or freight broker. All physical transportation, towing, winching, and delivery services are performed by independent, fully licensed, and insured third-party transport contractors. By utilizing our service, you acknowledge and agree that Shift Containers is solely facilitating the connection between you and the independent contractor.

2. Limitation of Liability & Hold Harmless

Because Shift Containers does not directly operate the transport vehicles or employ the drivers, you agree to hold Shift Containers, its owners, and affiliates completely harmless from any and all claims, liabilities, damages, or expenses arising from the transport of your container. This includes, but is not limited to:

• Damage to the shipping container, doors, or internal cargo.
• Damage to property, including cracked concrete, broken asphalt, rutted lawns, damaged fences, or underground utilities (e.g., septic tanks, sprinkler systems) caused by the heavy-duty trucks.
• Delays in pickup or delivery due to weather, mechanical failure, or driver scheduling.
• Accidents, injuries, or bodily harm occurring on the property during loading or unloading.

Any claims for damages must be filed directly with the independent contractor who performed the transport service and their respective insurance provider.

3. Customer Responsibilities & Site Preparation

To ensure a safe and compliant delivery, the customer agrees to the following requirements. Failure to meet these requirements may result in the driver refusing service, and a "dry-run" fee may be assessed by the contractor.

• Empty Containers Only: For DOT weight compliance and winch safety, containers must be 100% empty of all cargo and loose items.
• Clearance: The drop-off and pickup locations must have a minimum of 100 feet of unobstructed, straight-line clearance, and 16 feet of vertical clearance.
• Ground Conditions: The ground must be solid, relatively level, and dry enough to support a heavy-duty truck without sinking or losing traction. Drivers reserve the right to refuse dropping a container if they deem the terrain unsafe.

4. Indemnification

You agree to indemnify, defend, and hold harmless Shift Containers and its affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from your use of the service, your violation of these Terms, or any dispute between you and the independent third-party contractor.

5. Changes to These Terms

We reserve the right to update or modify this Privacy Policy and Terms of Service at any time. Any changes will be posted on this page with an updated revision date.
